Content Requirements

Developer represents and warrants that Developer Applications will:

• Not be intended for or used for any mission critical application where human life or property may be at stake;
• Not mislead or misrepresent to a wireless carrier, End User, WaveMarket or otherwise, as applicable, the function, purpose, scope or behavior of any Developer Application;
• Not use any information obtained from the Veriplace Platform for any purpose other than the Developed Application’s primary function; For example and illustrative purposes only, Developer will not use End User Data to send an End User marketing messages unrelated to the Approved Application that such End User accesses ;
• Not contain or allow transmission of content or any functionality, that:
• infringes any third party’s rights, including but not limited to intellectual property (i.e. copyright, trademark, patent, trade secret), personality, publicity, privacy or other rights;
• requires WaveMarket or a wireless carrier to obtain any licenses, permits and other permissions;
• is obscene, threatening, defamatory, fraudulent, libelous, deceptive or illegal;
• is racially or ethnically offensive, discriminatory, violent, harassing, adult-themed, sexually suggestive or explicit, profane or objectionable;
• it does not have the right to discloses or make available under any law, under contract or fiduciary relationship;
• facilitates the generation of SPIM, SPAM, or other unsolicited communications or phishing;
• depicts violence, prejudice, discrimination or racism;
• is unsolicited, including without limitation, "junk mail," "bulk e-mail", spam or other unsolicited advertising material;
• Not allow End Users to use or attempt to use another's account, to create a false identity or to impersonate another person;
• Be in compliance and consistent with all user conduct and user content rules established by WaveMarket or otherwise applicable to the Developer Application;
• Not cause or enable the distribution of any viruses, Trojan horses, trap doors, back doors, worms, time bombs, e-mail bombs, cancelbots, adware, spyware, malicious code or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personally identifiable information;
• Not attempt to or facilitate illegal, harmful or unethical activities of any type;
• Not interfere with the rights of others to use the Veriplace Platform;
• Not reflect poorly upon, disparage or devalue WaveMarket's reputation or goodwill, as determined in its sole discretion;
• Not cause damage to, interfere with, disrupt the Veriplace Platform, WaveMarket-provided services or any networks or services with which the Veriplace Platform interfaces;
• Not attempt to or gain unauthorized access to Veriplace, End User Data or any system or network related to Veriplace (through hacking, password mining or any other means);
• Not infringe or use WaveMarket’s brand, logos and/or trademarks, including, without limitation the word "Veriplace," except as expressly provided in the Veriplace Developer Terms of Service;
